TERMS OF SALE
The website www.ciclibortolotto.it (or www.bortolottocycle.uk) is managed by Bortolotto & C. S.r.l. (hereinafter CICLI BORTOLOTTO) with headquarters in Via Casilina, 1115 - 00133 Rome (RM) Italy.
The sale of products on www.ciclibortolotto.it (or www.bortolottocycle.uk) is governed by the following "general conditions of sale" which form an integral part of the online sales contract entered into between the buyer - hereinafter referred to as the Customer - and CICLI BORTOLOTTO - hereinafter referred to as the Seller.
All contracts for the purchase of products concluded through the website www.ciclibortolotto.it (or www.bortolottocycle.uk), in the absence of specific or particular agreements between the Seller and the Customer, will be regulated in accordance with the provisions of these General Conditions.

1 - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1) The contract stipulated between CICLI BORTOLOTTO and the Customer must be considered concluded with the acceptance, even if only partial, of the order by CICLI BORTOLOTTO which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

2) If the Customer is a final consumer (i.e. a natural person who has reached the age of majority and who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save in electronic format and, in any case, to keep these general conditions of sale, in compliance with the provisions of art. 7 of Legislative Decree n. 206/2005 on distance selling.

3) Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability of the seller for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

2 - HOW TO PURCHASE
1) The Customer can only purchase the products present in the electronic catalog of www.ciclibortolotto.it (or www.bortolottocycle.uk) at the time of placing the order and which can be viewed at the address (URL) www.ciclibortolotto.it (or www.bortolottocycle.uk), as described in the relevant information sheets. The technical information included on the www.ciclibortolotto.it site (or www.bortolottocycle.uk) faithfully reproduces those of the manufacturers of the goods included in the catalogue. CICLI BORTOLOTTO, therefore, reserves the right to modify/adapt the technical information of the products to match those provided by the manufacturers, without the need for any prior notice. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics, and may differ in color and size from the actual products indicated in the catalogue. So that all the information supporting the purchase, as well as the images represented, are to be understood as simple generic information material not necessarily and obligatorily referable to the real characteristics of each individual product.

2) The correct receipt of the order is confirmed by CICLI BORTOLOTTO with an answer via automatic e-mail, sent to the e-mail address communicated by the Customer during the order procedure. This confirmation message will contain the Date and Time of execution of the order and a "Customer Order Number" to be used in any further communication with CICLI BORTOLOTTO. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. The Customer can also check the status of his order by accessing the web area dedicated to him. To access the dedicated area, you will need to log in from the site and then choose the "Order History" item.

3) In the event of non-acceptance of the order, CICLI BORTOLOTTO undertakes to timely notify the Customer, in the same manner.

4) All products are presented on the site with prices in Euros and excluding VAT. CICLI BORTOLOTTO reserves the right to change the prices of the products at any time, without notice. The change in prices cannot lead to claims for compensation by customers.

5) On the website www.ciclibortolotto.it (or www.bortolottocycle.uk) availability is visible at the time of the order. Since the simultaneous access of multiple user-customers and the simultaneous possibility of receiving multiple "online" orders could modify the availability of the product, CICLI BORTOLOTTO does not guarantee the certainty of assignment of the goods ordered until the order itself is visible in the area "Order History" and until the payment methods are successful.

6) For certain products, subject to discounts and/or promotions, CICLI BORTOLOTTO reserves the right to accept, in a limited manner, the orders received and/or to limit the quantities ordered, upon notification to be forwarded to the Customer. If the Customer does not accept the aforementioned limitations, the order must be considered cancelled.

3 - TERMS OF PAYMENT
The payment methods accepted on the website www.ciclibortolotto.it (or www.bortolottocycle.uk) are as follows:
1) Cash on delivery of the goods (with the limitations of the law)
2) Advance bank transfer
3) Credit card
4) Paypal
5) Satispay
6) At the point of sale

4 - DELIVERY METHODS
By subscribing to the registration, you provide CICLI BORTOLOTTO with the authorization to carry out the delivery of the goods through its own courier.
For every order placed on the website www.ciclibortolotto.it (or www.bortolottocycle.uk), CICLI BORTOLOTTO will issue a regular Accompanying Invoice for the material sold. For the issuance of the document itself, the information provided by the Customer at the time of the order will prevail.
Payment for the goods by the customer will be made using the method chosen when placing the order. No further expenses or commissions are due to CICLI BORTOLOTTO. Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated on the Accompanying Invoice;
- that the packaging is intact, not damaged or wet or, in any case, altered, even in the sealing materials (adhesive tape or metal strapping).
In any case, the courier is not authorized to have checks carried out on the purchased item and therefore will not be able to have the package opened to check its status.

5 - DELIVERY COSTS AND COURIERS
The goods are delivered by CICLI BORTOLOTTO through its own personnel or a trusted courier.
Transport costs vary according to the delivery address indicated by the customer:
- In the event of an order with a value including VAT of less than €80.00, the transport cost is charged to the customer based on the weight and destination of the goods;
- in the event of an order with a value including VAT greater than €80.00, the transport cost will be borne by CICLI BORTOLOTTO for any destination in Italy;

6 - MANAGEMENT OF ANY ERRORS IN THE PRICING
The prices indicated for each item are valid while stocks last, except for material errors of transcription, typing, printing or calculation of the prices themselves caused involuntarily or accidentally or deriving from defects ("bugs") of the information system. The same prices may also undergo variations in the event of exceptional fiscal, currency or social interventions. If, even after having made the purchase and paid for it, an error or a change in the price attributable to one of the causes listed above should be detected, CICLI BORTOLOTTO reserves the right to proceed with the relative price integration in favor of itself or of the Customer.

7 - RIGHT OF WITHDRAWAL
The right of withdrawal, established by law for purchases made by final consumers, applies within the 14th day of receipt of the goods. For any further information and details, consult the appropriate "SHIPMENTS and RETURNS" section available on the website.

8 - WARRANTIES
1. All products marketed by CICLI BORTOLOTTO are covered by the manufacturer's conventional guarantee and by the 24-month guarantee for lack of conformity, pursuant to Legislative Decree n. 24/02. To use the warranty assistance, the Customer must keep the document that he will receive together with the purchased goods.
2. The manufacturer's standard warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Assistance Centre, the defect is not covered by the manufacturer's standard warranty, the Customer will be charged for any costs of verification and recovery requested by the Authorized Assistance, as well as transport costs, if supported by CICLI BORTOLOTTO.
3. The 24-month guarantee pursuant to Legislative Decree n. 24/02 applies to products that present a lack of conformity, provided that the same is used correctly, in compliance with its intended use and with the provisions of the attached technical documentation. This guarantee, in accordance with Legislative Decree N. 24/92, is reserved only to the private consumer (natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, CICLI BORTOLOTTO shall restore the conformity of the product by means of repair/replacement or a reduction in the price, at no cost to the Customer, until the termination of the contract. If, following an intervention by an Authorized Assistance Center, there should not be a lack of conformity pursuant to Legislative Decree n. 24/02, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs if incurred by CICLI BORTOLOTTO.
4. Replacements in the event of a product not working on first use (Dead On Arrival: DOA), without prejudice to the existence of the conditions for the application of Legislative Decree n. 24/02, will be carried out only if expressly provided for by the manufacturer. The times for replacing or repairing the product depend exclusively on those indicated by the manufacturer. The Customer can then interface directly with the assistance centers or entrust CICLI BORTOLOTTO with dealing with the management of the fault. The transport costs will still be charged to the customer.
5. In the event that, for any reason, CICLI BORTOLOTTO is unable to replace a product under warranty (restored or replaced), it may proceed, with the Customer's consent, to replace the product itself (if still in the price list) or with another of the same characteristics and value or, lastly, the issue of a discount voucher for the same amount that can be spent on another product valid for 6 months from the time of issue.
6. No damages can be requested from CICLI BORTOLOTTO for any delays in carrying out repairs or replacements of products under warranty.
7. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ..); to limit damage to the original packaging, we recommend, when possible, to place it in a second box; the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided in all cases.

10 - REFUNDS
All refunds to customers following material sent that does not conform to that ordered will be made by bank transfer within 15 working days to the customer's c/c who must promptly send the data to receive payment.

11 - COMPLAINTS
Any complaint must be sent to the administration through the Contact area after which the Customer will be contacted as soon as possible in order to resolve the problem.

12 - JURISDICTION AND GOVERNING LAW
The sales contract between the customer and CICLI BORTOLOTTO is understood to be concluded in Latina and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Rome.

13 - CONDITIONS
The conditions contained in this document may be modified by CICLI BORTOLOTTO without notice and will be valid from the date of publication on the website www.ciclibortolotto.it (or www.bortolottocycle.uk)
